On 11 December, imprisoned chair of REAL movement Ilgar Mammadov commented on the interview of Novruz Mammadov, assistant to the president of Azerbaijan on Foreign Policy/Head of Department, dated 7 December via his lawyer.
Ilgar Mammadov confirmed again that he did not intend to apply to the court for conditional early release since the European Court of Human Rights concluded that the purpose of his arrest and conviction was silencing him and obstructing his political activities. Therefore he should be immediately and unconditionally released.
Regarding the constructive discussions about the resolution of the issue noted by the government representatives, Ilgar Mammadov stated that he was ready to submit a motion requesting withdrawal of the Committee of Minister’s referral of the case to the European Court of Human Rights if he was fully acquitted – as there was no crime committed – and his political activities would not be obstructed as a part of the implementation of Azerbaijan’s international legal commitments,.
The Committee of Ministers of the Council of Europe referred the case of Ilgar Mammadov back to the European Court of Human Rights to decide whether its non-implementation is a further violation of the convention launching the infringement proceedings against the country.
Ilgar Mammadov was arrested on 24 January 2013 during public protests in Ismayilli on charges of the organization of actions promoting infringement of a social order, and application of violence concerning the representation of authority. He was subsequently sentenced to 7 years in prison by the Shaki Court of Grave Crimes.
